Little voice warning me about seller shooters

Hi,

 

Spoke to Captain Moleka yesterday and was informed that they obtained a search warrant to search both the sellers properties for possible more incriminating evidence to help with the case. He advised that the court case will happen next week and he will be on touch with everybody in this regard to testify in court if required.

how about me? im in mozambique and have also been scammed. i still have the bank deposit slip. what do you advise me to do? the embassy wasnt that helpful

Hi Cuan and everyone!

 

Spoke to Capt Moleka on Friday 10th Dec 2010.He told me that the Courts were busy checking all Bank Accounts etc

as well as having obtained a warrant of sort for their houses.He suggested I contact him him before xmas - which I will

surely do. Unfortunately we are all at the mercy of the court.Will let you know as soon as I have some news.

I am afraid no real news at the moment. Dockets have been re-submitted to the States Attorney to issue summons. That is all the information we have at the moment.

 

@Mikey - any news from your side?

Hello everyone and compliments of the season to you all.

Not much news at this time - spoke to the Captain again on Friday 14th Jan. It's going really slow -

 

In fact, I think its exactly what the "Shooter Crowd" would like to see. In anycase, I'm onto the Captain for info

almost weekly - the latest being that the "State Prosecutor" is sitting and studying the evidence he has at hand.

- Really don't know where this is going - but I will continue to chase this one down!!!

 

The last piece of conversation I had with the Captain was that he told me to phone him again with my case no,

- which I will duly do before the end of this week. Maybe if we all gang up and bombard him with calls and queries, we can

liven up the case again.

Hi everyone!

 

Spoke the Captain today. (18 Feb 2011) The "Shooters crowd" will be subpoenaed again in a week or so as all

the evidence has now been re-examined.

I asked him if there was any chance of a "mistrial" or a possibility of the case being

"thrown out of court" - to which he replied : " not a chance - there are too many cases against them!"

So we will all adopt the "wait and see" attitude and hope that the law will take it's course.

Hi Everyone

 

Sorry for late update - Spoke to Captain Moleka today (7/04?2011) - I really wanted a chance to chat to the Prosecutor personally,

but he (capt Moleka) suggested we should wait until he gets the "Docket" from the prosecutor on April 15th.

Will call him then to see what's happening and will let you all know asap.

Playing the waiting game....

 

I did not lay a charge with my local Police Station when the "brown stuff" hit the fan. I was scammed out of R5800.00. I will wait and see what the outcome of the pending case is, and if they get off without a jail sentence, then I will lay a charge....and start the whole process over again. I have no intention of letting them think that they have gotten away with it!!!

Think you should lay a charge before anything else happens - and then you also gave:"case" against them (excuse the pun)

This is far from over!

 

Just an update - I could not get hold of Captain Moleka for a while now and contacted his office (commercial crimes). He was

involved in a car accident, hence him not being available. I spoke to a Colonel in the same dep and he assured me that the case is with the "Specialised Crime Court" in Pretoria and is by no means over.

 

Will post any other news as soon I get them.

From personal experience , the more evidence the special crimes unit has , the better chance of a successful prosecution .

 

It really does not make sense to wait and then start the process over again , particularly considering the length of time these cases take and when you will then probably be the only person laying a charge. you stand far less chance of getting anywhere !

 

I recommend you get hold of the person dealing with the case and add yours to it. The more evidence the police have against the scamster , the better chance there is of him getting a jail sentence. The police are going to be less enthusiastic about pursuing a case that has already been tried and failed so get in now while they are still active with it.

We spoke to the prosecutor last week and the news is that they are still busy with their investigation, they are trying to ensure they have concrete proof that the seller tried to commit fraud, at this point in time they are not satisfied that the evidence is strong enough for a criminal case, as they feel that the seller was operating a business and they need to prove intent. Currently they are trying to track the money that was withdrawn, around R60k, there is apparently still about R90k in the account but due to the investigation these funds have been frozen. The prosecutor wants to ensure that if they go to trial that they have a solid case and not risk it being thrown out due to insufficient proof/evidence and that they intended to defraud. Either way, the seller, if not found guilty by a criminal court is still required to supply or refund the buyer if they cannot deliver. But then this becomes a civil matter.

 

That's how it stands at the moment, the prosecutor also requested that they are not "pressured" or hurried along to resolve this too quickly.

i suspect this case will eventually be discarded. I'm one of those that was defrauded. i opened a case then and have had no feed back at all from the SAPS. These cases have been going on for a very long time now.

The IO is busy finalizing the evidence against the accused, according to the Captain, it should go back on the court roll next month hopefully.

The longgggggggg arm of the law...........

 

I was one of those that were defrauded, but I did not lay a charge at the SAPS, because of exactly what is happening (or more accurately, what is NOT happening) regarding this case.

 

I regard myself as a law-abiding citizen, but sometimes, just sometimes, I get the urge to acquire a baseball bat!!!!
